Rosa v. Dime Community Bancshares, Inc., et al., Index No. 506162/2016 (Kings County, March 16, 2017)
In this banking action, plaintiffs sought to recover the alleged proceeds of several accounts held as Totten Trusts and in which plaintiffs were named as the beneficiaries, and for an accounting of those accounts. In obtaining summary judgment dismissing the complaint against the bank, our firm established that it was indisputable that, prior to her death the account holder closed the accounts and all proceeds thereof were properly disbursed by the bank, and also that all funds had been properly accounted for.
